Terms and Conditions of Sale

These terms and conditions of sale ("TCS") apply to all sales of products made on the website sunaya-home.fr by SUNAYA SARL ("SUNAYA", "the Seller"). Placing an order entails unreserved acceptance of these TCS.

Article 1 — Purpose

The purpose of these TCS is to define the rights and obligations of the parties in the context of the online sale of furniture, decoration and outdoor products offered by SUNAYA on its website.

Article 2 — Acceptance

Acceptance of the TCS is materialized by ticking the box "I have read and accept the terms and conditions of sale" when validating the order. The TCS are binding on any user of the website who places an order. The user acknowledges having read them before ordering.

Article 3 — Products and prices

Products are described and presented with the greatest accuracy. However, errors or omissions may exist. Photographs and visuals are not contractual. SUNAYA reserves the right to modify its product selection at any time.

Prices are indicated in euros, including all taxes (VAT included), excluding delivery fees displayed before order validation. SUNAYA reserves the right to modify its prices at any time, it being understood that the price shown in the cart on the day of the order will be the only one applicable.

Article 4 — Order

The user selects the products, adds them to the cart, follows the order steps and validates after accepting the TCS. A confirmation is sent by email to the address provided. SUNAYA reserves the right to refuse any order for legitimate reasons (prior dispute, payment anomaly, etc.).

Contractual information is retained by SUNAYA and may be communicated upon request.

Article 5 — Payment

Orders are payable in euros, at the time of order, by:

  • Credit card via the provider Stripe (Visa, Mastercard, etc.). Payment data does not pass through SUNAYA;
  • Installment payment via the provider Alma (3 or 4 installments). Alma performs a solvency check; the credit is concluded between the customer and Alma (or its banking partner), of which SUNAYA is not a party.

The sums collected are not considered deposits, unless otherwise stated.

Article 6 — Delivery

Delivery terms, times, receipt and handling of anomalies are detailed on the Delivery, Returns and Withdrawal page, which is an integral part of these TCS.

Article 7 — Right of withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, the consumer has a 14-day period to exercise the right of withdrawal, under the conditions set out on the Delivery, Returns and Withdrawal page.

Article 8 — Warranties

The products are subject to the applicable legal warranties: warranty of conformity (Art. L217-4 et seq. of the French Consumer Code) and warranty against hidden defects (Art. 1641 et seq. of the French Civil Code), detailed on the Delivery, Returns and Withdrawal page.

For digital goods or digital content, the provisions of Directive (EU) 2019/770 apply where relevant.

Article 9 — Liability

SUNAYA makes every effort to ensure the availability and conformity of the website and products. Its liability cannot be incurred for: temporary unavailability of the website, interruptions related to maintenance operations, force majeure, or fault of the customer or a third party.

SUNAYA markets products under a dropshipping model: in accordance with the Kamenova case law (CJUE, April 30, 2019, case C-105/17), SUNAYA remains solely liable for the conformity of the goods sold towards the consumer, even when the supplier ships directly.

Article 10 — Personal data

The processing of personal data is described in the Privacy Policy, which is an integral part of these TCS.

Article 11 — Intellectual property

All elements of the website (texts, visuals, logos, trademarks, graphic charter) are the property of SUNAYA or its partners and are protected by intellectual property law. Any reproduction, representation or distribution, in whole or in part, without prior written authorization, is prohibited and constitutes infringement.

Article 12 — Applicable law and mediation

These TCS are governed by French law. In the event of a dispute, an amicable solution will be sought first.

In accordance with Article L612-1 of the French Consumer Code, the consumer customer may have free recourse to a consumer mediator for the amicable resolution of a dispute. The details of the mediator appointed by SUNAYA are communicated upon written request to contact@sunaya-home.fr.

In accordance with Article L612-2 of the French Consumer Code, we inform you that the European Commission provides an Online Dispute Resolution (ODR) platform, accessible at webgate.ec.europa.eu/odr.
